THE DISAPPEARED OF THE BEACH OF BRAZZAVILLE: STATEMENT BY THE EPISCOPAL
COMMISSION, JUSTICE AND PEACE OF THE CHURCH

Like all Congolese, we followed on the Radio France Internationale (RFI)
the request of the Congolese Government to the judges of the
International Court of Justice in The Hague, seeking to have the French
judge cease and desist from the court instruction procedure  opened
against Mr. Norbert DABIRA with respect to the affair of the disappeared
of the Beach of Brazzaville.

If the reasons evoked by the Congolese Government are well founded, the
government move is yet surprising and ambiguous- We do not understand
why the government should intervene to protect a citizen who is pursued
by the justice system, even if the facts interest the life of the
nation.=20

--The Congolese judge opened the case since the year 2000. And yet, till
today, Congolese know nothing of the level of instruction of the case.
National reconciliation and unity of the nation are an inspiration of
all the Congolese, and the government is not the only one to be
concerned about it. Besides, it has the duty and historic responsibility
to bring the process to term.

The Commission, Justice and Peace, is following with intelligence the
investigations by the OCDH (Congolese Observatory for Human Rights) and
the FIDH (International Federation of Human Rights Leagues) with respect
to this case. The Commission, Justice and Peace, spouses the points of
view of these two organizations, which have been pleading for the end of
impunity in Congo-Brazzaville.

By means of this statement, the Episcopal Commission, Justice and Peace,
wants to say: "That the independence of the Congolese judge is formal,
and that the Congolese judge, at the level of facts, cannot read the law
in total freedom with respect to this case of the disappeared of the
Beach and even  with respect to all the crimes of the last wars". As a
result, it becomes necessary to encourage the involvement of a
jurisdiction that is independent of any Congolese political power. And
yet, if modern justice, as a repressive instrument, has the merit of
seeking the truth about the facts and to punish the guilty, it cannot,
unfortunately, lead to a good reconciliation.=20

*      That the reconciliation being spoken of by the government can
only be made in silence, in the forget-fullness of the victims, without
listening to the suffering of the parents of the victims, without
reparation, without the truth, without the recognition of the ill
committed." This affair has lasted too long, and the government must
publicly pronounce itself on the concrete manner in which it hopes,
finally, to shed light on all the crimes perpetrated during the last
wars. Reconciliation must not be a pretext to silence crimes.
Humanitarian law requires the respect of the civilians in the armed
conflicts.

For once, in the country, we witnessed massive and large-scale human
rights violations; these war crimes cannot remain unpunished. For
reasons of clarity, the government must let "independent courts" act;
courts, which can help in the search of the truth in total impartiality.
